1. About Selection

These Terms of Service ("Terms") govern access to and use of Selection, including Selection Studio, Selection-powered public Experiences and related services.

Selection is operated by:

IVAN KNEŽEVIĆ PR PRIVATNI SMEŠTAJ SELECTION BEOGRAD (STARI GRAD) Dobračina 9 11000 Belgrade (Stari Grad) Serbia

PIB: 107065001 MB: 62473835

Contact: office@selection.rs Website: https://selection.rs

In these Terms, "Selection", "we", "us" and "our" refer to the operator identified above.

2. Legal Bundle

These Terms form part of the Selection Legal Bundle together with the Acceptable Use Policy, Privacy Policy and Content Rights & Takedown Policy.

By accepting these Terms, you agree to comply with these Terms, the Acceptable Use Policy and the Content Rights & Takedown Policy as applicable to your use of Selection.

You acknowledge that you have been provided access to the Selection Privacy Policy, which explains how personal data is processed.

Acknowledging the Privacy Policy does not constitute blanket consent to all personal-data processing. Where consent is required for a particular processing activity, it will be requested separately where appropriate.

3. Eligibility and Studio access

Selection Studio is intended only for account holders who are at least 18 years old and legally capable of entering into this agreement.

By accepting these Terms, you represent that you satisfy these requirements.

Studio access is provided to the authorized account holder. You are responsible for maintaining reasonable control of your account, authentication mechanisms, devices and authenticated Studio sessions.

You must not knowingly provide or permit Studio access to a person who is not authorized to use your account.

Selection does not claim to know or verify the age or real-world identity of every person who may physically use an authenticated device or session.

The 18+ Studio requirement does not mean that every public Selection Experience is automatically restricted to an adult audience.

4. Accounts and onboarding

Access to Studio may require an onboarding request and approval by Selection.

Selection may approve, reject, restrict, suspend or terminate access in accordance with these Terms, applicable policies and applicable law.

Information provided during onboarding must be materially accurate and must not intentionally impersonate another person or organization.

Approval of an onboarding request does not transfer ownership of Selection infrastructure, domains, software or platform technology to the User.

5. The Selection service

Selection provides tools that allow Users to create, manage and publish digital Experiences and Content.

Selection provides the platform and technical infrastructure. Creators determine the Content they create and publish and remain responsible for that Content.

Selection does not undertake to manually inspect, legally approve or endorse every item of Creator Content before publication.

The availability of a publishing tool or technical capability does not mean that every possible use of that capability is lawful or permitted.

6. Creator Content and ownership

Creators retain ownership of Content they create or own, subject to rights held by third parties.

Using Selection does not transfer ownership of Creator Content to Selection.

By creating, uploading or publishing Content through Selection, you represent that you have the rights, permissions, licences or other lawful authority necessary for your use of that Content.

You are responsible for Creator Content and for the consequences of creating, uploading, embedding, linking to or publishing it.

7. Licence to operate the service

By uploading, creating or publishing Content through Selection, you grant Selection a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transform, transmit, display and otherwise technically use that Content only to the extent reasonably necessary to provide, operate, secure and maintain Selection and to make your Content available as instructed by you.

This licence permits technical operations such as storing Draft and Live content, processing or optimizing media, copying assets during publication, generating runtime representations and delivering published Content to Visitors.

This licence does not transfer ownership of Creator Content to Selection and does not give Selection a general right to sell Creator Content as Selection's own content.

8. Acceptable use

You must comply with the Selection Acceptable Use Policy.

You must not use Selection for unlawful activity or to create, upload, publish, distribute or facilitate Content prohibited by that Policy.

This includes, among other prohibited uses, child sexual abuse or exploitation material, pornography where prohibited by Selection policy, content that infringes third-party rights, malicious activity, fraud and other prohibited or unlawful uses described in the Acceptable Use Policy.

9. Third-party rights

You must respect copyright, trademark, privacy, publicity and other rights of third parties.

Public availability of material on the Internet does not by itself mean that you have permission to republish or use it.

Rights complaints are handled under the Selection Content Rights & Takedown Policy.

10. Selection enforcement

Selection may take proportionate action where it reasonably believes that Content or use of the service violates these Terms, the Acceptable Use Policy, the Content Rights & Takedown Policy or applicable law.

Depending on the circumstances, Selection may:

  • restrict specific Content;
  • disable access to specific Content;
  • remove Content;
  • suspend Studio access;
  • terminate Studio access;
  • preserve relevant records where reasonably necessary;
  • comply with valid legal requirements.

Where reasonably possible and appropriate, Selection may target action to the affected Content rather than unrelated Content.

Selection enforcement is separate from User-controlled lifecycle actions such as Archive or Unpublish.

11. Reports and takedowns

Selection may receive complaints from rights holders, Visitors, authorities or other persons concerning Creator Content.

Selection may investigate sufficiently specific reports and may take appropriate action, including restricting, disabling access to or removing reported Content.

Where appropriate, affected Creators may be informed of the action and may request review in accordance with the Content Rights & Takedown Policy.

12. Account suspension and termination

Selection may suspend or terminate access where reasonably necessary, including for serious or repeated violations, security risks, fraud, abuse, unlawful activity, infringement of third-party rights or failure to comply with these Terms or incorporated policies.

A serious single violation may justify immediate action.

Termination or restriction of Studio access does not automatically erase records that Selection is entitled or required to retain for legal, security, dispute-resolution or operational purposes.

13. Third-party services

Selection may enable links to or embeds from third-party services such as video, map, social or communication providers.

Third-party services are independently operated and may be governed by their own terms and privacy policies.

Selection is not responsible for the continued availability, accuracy or independent conduct of third-party services.

14. Service availability and changes

Selection may change, improve, replace, limit or discontinue features of the service.

Selection does not guarantee that every feature will always be available without interruption or error.

We may perform maintenance, respond to security incidents, modify infrastructure or make other operational changes reasonably necessary to operate the service.

15. Beta and evolving features

Selection may make features available while they are being developed, tested or refined.

Such features may change, contain errors or be discontinued.

The presence of a beta or developing feature does not reduce the User's responsibility to comply with these Terms and applicable law.

16. Disclaimer

To the extent permitted by applicable law, Selection is provided on an "as available" basis.

Selection does not warrant that the service will be uninterrupted, error-free or suitable for every particular purpose.

Nothing in these Terms excludes rights or protections that cannot lawfully be excluded.

17. Responsibility and limitation of liability

Creators are responsible for their Content and their use of Selection.

To the extent permitted by applicable law, Selection is not responsible for Creator Content merely because Selection provides the tools, infrastructure or technical means used to host or publish it.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

Selection's ability to restrict or remove Content does not make Selection the author, owner or endorser of Creator Content.

18. Indemnity

To the extent permitted by applicable law, a User is responsible for claims, losses or costs arising from the User's unlawful Content, violation of third-party rights or material breach of these Terms.

This provision does not apply to the extent that liability results from Selection's own conduct for which liability cannot lawfully be excluded or transferred.

19. Privacy

Selection processes personal data as described in the Selection Privacy Policy and applicable law.

The Privacy Policy explains, among other matters, categories of information processed, purposes, service providers, browser storage, international processing, retention and applicable privacy rights.

20. Governing law

These Terms are governed by the laws of the Republic of Serbia, without prejudice to mandatory rights or protections that may apply under other applicable law.

Nothing in these Terms deprives a person of mandatory protections that cannot lawfully be excluded by agreement.

21. Changes to the Legal Bundle

Selection may update these Terms or other documents in the Legal Bundle as the service, applicable law or Selection's practices change.

Legal documents are versioned.

Where Selection determines that a material update requires renewed acceptance, continued Studio access may be conditioned on the account holder reviewing and accepting the applicable updated terms.

An updated Privacy Policy may instead require acknowledgement or other action appropriate to the nature and legal basis of the change.

22. Business restructuring

Selection may reorganize, incorporate or transfer operation of the Selection service to another legal entity where permitted by applicable law.

Where such a change materially affects the contractual relationship or identity of the controller, Selection will provide appropriate notice and, where Selection determines it is required, request acceptance of an updated Legal Bundle.

23. Language

These documents may be made available in multiple languages. In the event of an inconsistency between translations, the English version will prevail, except where applicable law requires otherwise.
