Content Rights & Takedown Policy

Version
1.0
Effective date
17 August 2026

1. Purpose

This Content Rights & Takedown Policy explains the rules governing Content created, uploaded, embedded, linked, published or otherwise made available through Selection and the process for reporting Content that may infringe copyright, intellectual-property rights or other applicable rights.

This Policy forms part of the Selection Legal Bundle and should be read together with the Terms of Service, Acceptable Use Policy and Privacy Policy.

2. Creator ownership

Creators retain ownership of Content they create or own, subject to rights belonging to third parties.

Using Selection does not transfer ownership of Creator Content to Selection.

Creators remain responsible for determining whether they have the rights, licences, permissions or other lawful authority necessary to use and publish their Content.

3. Licence required to operate Selection

By uploading, creating or publishing Content through Selection, the Creator grants Selection a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transform, transmit, display and otherwise technically use that Content only to the extent reasonably necessary to provide, operate, secure and maintain Selection and make the Creator's Content available as instructed by the Creator.

This licence does not give Selection ownership of Creator Content.

It permits technical operations necessary for the service, including:

  • storing Draft and Live Content;
  • copying Content during publication;
  • processing or optimizing uploaded media;
  • generating or delivering runtime representations;
  • transmitting Content through infrastructure providers;
  • displaying published Content to Visitors;
  • maintaining reasonable technical, security and operational copies.

Selection does not acquire a general right to sell Creator Content as Selection's own Content merely because it has been uploaded to the platform.

4. Creator responsibility

By uploading or publishing Content through Selection, the Creator represents that they have the rights or lawful authority necessary to do so.

This may include Content created by the Creator, Content licensed to the Creator, Content used with permission or Content whose use is otherwise permitted by applicable law.

Creators must not knowingly use Selection to publish Content that infringes another person's:

  • copyright;
  • trademark rights;
  • privacy or publicity rights;
  • contractual rights;
  • intellectual-property rights;
  • other rights protected by applicable law.

A Creator should not assume that Content is free to use merely because it is publicly available on the Internet.

5. Third-party services and embedded Content

Selection may allow Creators to reference or embed Content hosted by third-party services, including services such as YouTube or Google Maps.

Embedding, linking to or referencing third-party Content does not transfer ownership of that Content to Selection or the Creator.

Creators are responsible for ensuring that their use of third-party Content complies with applicable law and, where relevant, the terms governing the third-party service.

Third-party providers may independently restrict, remove or disable Content hosted on their services.

Selection cannot guarantee the continued availability of third-party Content.

6. Reporting rights violations

If you believe that Content available through Selection infringes your copyright, intellectual-property rights or other applicable legal rights, you may submit a notice to:

office@selection.rs

The notice should provide enough information for Selection to identify and evaluate the reported Content.

Where applicable, please include:

1. your name and contact email;

2. identification of the right you believe is being infringed;

3. identification of the protected work, material or interest concerned;

4. the exact Selection URL or other sufficiently precise electronic

location of the reported Content;

5. an explanation of why you believe the Content infringes your rights;

6. information reasonably supporting your claim or authority to act for

the rights holder;

7. a statement that you believe in good faith that the information and

allegations in your notice are accurate and complete.

Selection may request additional information where reasonably necessary to evaluate the notice.

7. What happens after a notice

Selection will review sufficiently specific notices in a manner appropriate to the circumstances.

Depending on the nature and apparent validity of the notice, Selection may:

  • request additional information from the reporting party;
  • contact the affected Creator;
  • temporarily restrict access to specific Content;
  • disable access to specific Content;
  • remove specific Content;
  • require the Creator to modify or remove Content;
  • restore Content where a claim is not sufficiently supported;
  • preserve relevant information where reasonably necessary;
  • suspend or terminate Studio access in serious or repeated cases;
  • take no action where the notice does not provide a sufficient basis for action.

Selection does not guarantee that every report will result in removal.

Where reasonably possible and legally appropriate, Selection will target action to the specific Content concerned rather than unnecessarily restricting unrelated Content.

8. Notice to the affected Creator

Where Selection removes, disables or otherwise restricts Creator Content because it is considered unlawful or incompatible with Selection's policies, Selection may inform the affected Creator of:

  • the Content affected;
  • the action taken;
  • the principal reason for the decision;
  • whether the action followed a third-party notice, where appropriate;
  • available means of requesting review.

Where applicable law requires a particular notice or statement of reasons, Selection will provide it as required.

Selection may withhold particular information where disclosure is prohibited by law or where withholding is otherwise permitted under applicable law.

9. Requesting review

A Creator who believes that Content was restricted or removed incorrectly may contact:

office@selection.rs

The request should identify the affected Content and explain why the Creator believes the decision should be reconsidered.

Selection may request additional information reasonably necessary to evaluate the request.

Following review, Selection may maintain, modify or reverse its original decision.

Submitting a review request does not guarantee restoration of Content.

10. False or abusive notices

Rights-reporting mechanisms must not be used to intentionally submit false, misleading, fraudulent or abusive claims.

Selection may reject notices that are clearly deficient, abusive or unrelated to identifiable Content available through Selection.

Repeated or serious misuse of Selection's reporting mechanisms may result in appropriate restrictions and may expose the reporting party to consequences available under applicable law.

Nothing in this section prevents a person from making a genuine good-faith report merely because the legal status of the reported Content is uncertain.

11. Repeat infringement and serious violations

Selection may suspend or terminate Studio access for Creators who repeatedly or seriously infringe the rights of others.

The appropriate response may depend on factors including:

  • the nature and severity of the infringement;
  • whether infringement is repeated;
  • whether previous warnings or removals occurred;
  • the reliability of notices received;
  • the Creator's response;
  • applicable legal requirements;
  • risks to Selection, rights holders or other Users.

Selection is not required to wait for repeated violations before acting where a single violation is sufficiently serious or immediate action is required by law.

12. Other unlawful or seriously harmful Content

This Policy primarily addresses Content-rights complaints.

Content involving other forms of illegality or serious harm may also be reported to:

office@selection.rs

Selection may take appropriate action where reasonably necessary to address an apparent serious violation of law, immediate safety risk, abuse of the service or another matter requiring intervention.

Such reports may also fall under the Acceptable Use Policy.

13. Preservation and disclosure

Receiving a notice does not automatically require Selection to permanently preserve the reported Content.

Selection may preserve relevant records where reasonably necessary to:

  • investigate a report;
  • resolve a dispute;
  • protect legal rights;
  • enforce Selection policies;
  • prevent abuse;
  • comply with applicable law or a lawful request.

Selection may disclose information where required by applicable law, court order or other legally binding process.

Personal data associated with notices and disputes will be handled in accordance with the Privacy Policy and applicable law.

14. Selection is not the owner of Creator Content

Selection provides infrastructure and tools that allow Creators to create and publish Experiences.

Except for Content expressly created or owned by Selection itself, Selection does not claim ownership merely because Content is hosted, processed or displayed through the platform.

Selection's technical ability to store, publish, restrict or remove Content does not mean Selection endorses, verifies or assumes ownership of that Content.

15. No pre-approval of all Content

Selection does not undertake to manually inspect or legally approve every item of Creator Content before it is published.

Creators remain responsible for their Content and for complying with applicable law and Selection policies.

Selection may nevertheless review, restrict, disable access to or remove Content where it becomes aware of a potential violation or where review is reasonably necessary to operate or protect the service.

16. United States copyright notices and DMCA

Selection accepts copyright-infringement reports at:

office@selection.rs

However, Selection does not represent through this Policy alone that it has completed the separate requirements necessary to claim safe-harbor protection under Section 512 of the United States Digital Millennium Copyright Act.

United States law provides a separate process under which qualifying service providers seeking Section 512 protection designate an agent to receive copyright notices and register that designation with the U.S. Copyright Office.

Until Selection completes any such designation and related requirements that it determines are appropriate, the general reporting and review procedure described in this Policy applies.

If Selection later implements a formal DMCA process, this Policy may be updated to identify the designated agent and establish the applicable DMCA notice and counter-notification procedure.

17. No determination of ownership

Selection's decision to remove, retain, restrict or restore Content is an operational decision concerning use of the Selection service.

Except where required by law, such a decision does not constitute a judicial determination of:

  • copyright ownership;
  • infringement;
  • validity of a licence;
  • ownership of intellectual property;
  • any other legal right between the parties.

Rights holders and Creators remain free to pursue remedies available under applicable law.

18. Changes to this Policy

Selection may update this Content Rights & Takedown Policy as the platform, applicable law or Selection's rights-management procedures change.

Each version will identify its version number and effective date.

Where a material update changes the legal terms applicable to Studio Users, Selection may require acceptance of the updated Legal Bundle before continued Studio use.

19. Language

These documents may be made available in multiple languages. In the event of an inconsistency between translations, the English version will prevail, except where applicable law requires otherwise.
